It's no secret that the reform of the system for managing and maintaining common property is a deeply affecting issue for our society. Every apartment owner will feel its results firsthand. The price of mistakes will be high, and a huge number of our residents will be justified in asking, "What were you all thinking?!"

Currently, a training center created on the basis of "ZHKH-INFO" LLP is improving the qualifications of hundreds of specialists from all regions of the Republic of Kazakhstan. At the same time, the "Housing and Utilities Certification Center" LLP is conducting qualification exams for those who have already completed their training.

It's no secret that the reform of the system for managing and maintaining common property is an issue that deeply affects our society. Every apartment owner will feel its results firsthand. The price of mistakes will be high, and a huge number of our residents will be justified in asking, "What were you all thinking?!"

As a result, after the amendments to the Law of the Republic of Kazakhstan "On Housing Relations" (approved on December 26, 2019), debates have not ceased to this day. Some of the most pressing questions are also being raised during the discussion of by-laws issued to form legal enforcement practices. At the same time, all interested parties accept and recognize that the new amendments have made it possible to create a system for improving the qualifications of specialists in the field of managing and maintaining common property.

Developing a Certification System

To implement these initiatives, the professional community of the ALE "Association of Management, Service, and Energy Service Entities in the Housing Sector 'Shanyrak'," in collaboration with Central Asian University JSC and "Labor Protection Center" JSC, promptly developed and approved professional standards for the management of residential and non-residential buildings. These standards serve as a basis for the assessment, attestation, certification, and qualification confirmation of personnel, as well as for their training and retraining.

Furthermore, by order of the Acting Minister of Industry and Infrastructure Development of the Republic of Kazakhstan on March 30, 2020, the qualification requirements for multi-apartment building managers were approved. On June 30, 2020, Minister of Industry and Infrastructure Development of the Republic of Kazakhstan B.B. Atamkulov approved the "Program for Improving the Qualifications of Specialists in the Field of Housing Relations and Housing and Utilities for the Management and Maintenance of Multi-Apartment Residential Buildings." Thus, the actions of government agencies and the professional community are aimed at creating a system for improving qualifications.

Recognizing the need to move in this direction, the Almaty HCA Association, the online portal "Bulletin of the Housing and Utilities Owner and Entrepreneur," and the National Association of Cooperatives and Other Forms of Economic Communities in the Republic of Kazakhstan took steps to create a training center and a certification center for specialists in the management and maintenance of residential and non-residential real estate. These efforts culminated in the Order of June 2, 2020, which included "Housing and Utilities Certification Center" LLP in the registry of specialist certification centers of the "ATAMEKEN" National Chamber of Entrepreneurs.

A New Approach to Training

Considering the accumulated experience, a new market product was created in a short period, allowing individuals who meet the qualification requirements to undergo online training at their convenience and subsequently pass a qualification exam in the form of a test. The training center, created on the basis of "ZHKH-INFO" LLP, is currently improving the qualifications of hundreds of specialists from all regions of the Republic of Kazakhstan. At the same time, "Housing and Utilities Certification Center" LLP conducts qualification exams for those who have already completed their training.
Given that there are currently about 9,000 different HCAs, CCs, HCHCs, MCs, and service companies registered in the Republic of Kazakhstan, we have provided an opportunity for all interested parties to take these advanced training courses. We are also preparing courses for members of the House Council, chairpersons of Property Owners' Associations (POAs), and authorized persons of Simple Partnerships (SPs), as well as for all active owners who may not need to confirm their qualifications but are nonetheless interested in gaining knowledge.

It's important to remember that, according to paragraph 1 of Article 48-1 of the Law of the Republic of Kazakhstan "On Housing Relations," "A multi-apartment residential building manager or a management company provides condominium property management services if they have specialists who have completed training and possess a document confirming their qualification to perform condominium property management functions." We want to be correctly understood that training is by no means an obligation for most market participants. The requirements for qualification confirmation are currently only stated for management companies.

However, given the specifics of our market, large management companies have concentrated significant residential assets under their management. Now, residents living in new residential complexes are increasingly asking for information about whether their "managers" have the relevant knowledge and a certificate.
Who knows, maybe with time, all market participants will understand the need to acquire knowledge. As POAs and Simple Partnerships replace HCAs, owners, in the person of their leaders, will take on greater responsibility. To avoid the mistakes that the first chairpersons of HCHCs made in the past, it's necessary to make efforts for a universal legal succession and a smooth transformation in this vital segment.

A Call for Professionalism

The events related to our society's difficult fight against the pandemic have also deeply affected the common property maintenance sector. All HCA chairpersons, management company employees, masters, and janitors were also on the front lines of the fight against the merciless and incomprehensible virus. Our specialists are carrying out a huge amount of daily work on disinfection, while also completing all the necessary tasks to prepare the housing stock for the heating season.

Like many others, we are suffering irreplaceable losses in this fight, and our industry truly needs professional specialists. In due time, your humble servant, speaking at another conference in Almaty, promised the attendees that he would do everything possible to organize advanced training courses.
